The Islamabad High Court has ordered the removal of terrorism clause from the case against Chairman PTI, former Prime Minister Imran Khan.
A 2-member bench headed by Islamabad High Court Chief Justice Athar Minullah heard the application.
The Chief Justice inquired that what opinion has been given by the JIT in this case?
The prosecutor said that this is the opinion of the JIT that the terrorism section is created in this case.
Imran Khan’s lawyer told the court that Imran Khan talked about taking action, which was a matter of legal action, there was talk of filing a case against IG Police and DIG, the request should have come from the affected people. He was horrified by this statement, this computer typed request was written with patience and there is a mastermind behind it, a case of terrorism can only be made on creating an atmosphere of fear and terror, not on the mere possibility of creating such an atmosphere. What impression will the case against Imran Khan leave on the international level?
Chief Justice Athar Minullah said that they do not go on it, they stay until the trial.
Imran Khan’s lawyer said that Imran Khan spoke in a rally which was prosecuted, the terrorism case for the speech is like making a mockery of the Anti-Terrorism Act.
The special prosecutor told the court that Section 186 has been removed from the case against Imran Khan.
Imran Khan’s lawyer said that the section which should have been removed was not removed, the court had stopped the filing of the challan, but the police have prepared the challan.
Chief Justice Athar Minullah said that the challan was not submitted to the trial court, this was also the order.
The prosecutor said that on the same facts, the investigating officer asked the IG twice to remove me from the case.
Chief Justice Athar Minullah said that Faisal Raza Abidi was also charged with two terrorism cases, he was acquitted in both cases, the Supreme Court has interpreted the terrorism law.
The Supreme Court reserved its decision on the plea to dismiss the terrorism case against Imran Khan.
The Islamabad High Court gave a reserved judgment after some time and ordered to drop the terrorism clause from the case against Imran Khan.
The Supreme Court in its decision said that the case will be conducted under provisions other than anti-terrorism.
